The owner's activity consists of compiling and selling databases of business establishments based on public sources. The owner is established outside the European Economic Area; the services it provides to recipients located in Spain are governed by the LSSI-CE to the extent applicable to them.
2. Purpose and acceptance
This Legal Notice governs access to and use of the ProfesionalRetail.com website (the “Site”), which offers information about the database of stores in Spain, free samples and the purchase of data exports. Accessing the Site makes you a user and implies acceptance of this Legal Notice in the version published at the time of access.
The purchase of databases is also governed by the Terms and Conditions and Database License, which prevail over this Legal Notice with respect to orders, delivery and the license.
3. Terms of use of the website
The user undertakes to use the Site lawfully, in good faith and in accordance with this Legal Notice, and not to:
- access or attempt to access restricted areas, other users' accounts or the owner's systems without authorization;
- circumvent the contact viewing limits, payment controls or other technical protection measures;
- extract the content of the Site (including the samples) massively or systematically by means of robots, scrapers or other automated means;
- introduce viruses or other elements that may damage or alter the Site, or overload its infrastructure;
- use the data in the samples to send unsolicited commercial communications or for other unlawful purposes.
The owner may suspend or restrict the access of a user who breaches these terms, without prejudice to any legal action that may be appropriate.
4. Intellectual and industrial property
The design of the Site, its texts, graphics, source code, the selection and arrangement of its content and the databases it contains are protected by intellectual property law, including the sui generis database right (Articles 133 et seq. of the Spanish Consolidated Text of the Intellectual Property Law). Except as provided in the license of a purchase, no right of reproduction, distribution, public communication or transformation is granted.
The trademarks, trade names and logos of chains and establishments that appear on the Site belong to their respective owners and are shown only to identify the chain or establishment to which the data refers. Their appearance does not imply any relationship, sponsorship or endorsement between those owners and ProfesionalRetail.com.
5. Content and liability
The information on the Site comes from public sources and is updated periodically. The owner takes reasonable care over its accuracy but does not guarantee that it is error-free, complete or permanently up to date. The figures for stores, categories, chains and prices are calculated automatically from the data as of the date indicated.
The owner is not liable for damage arising from service interruptions, technical failures or viruses not attributable to it, nor for any use of the Site by users contrary to this Legal Notice or to the law. Nothing in this section limits the rights that the law grants to consumers.

6. Links
The Site may include links to third-party websites (for example, the stores' websites in the samples). The owner does not control those websites and is not liable for their content, in accordance with Article 17 of the LSSI-CE, unless it has actual knowledge that they are unlawful and does not act diligently to remove or disable the link.
Anyone who wishes to link to the Site may do so to its home page or to any public page, provided that the link is not misleading as to its origin and does not suggest a non-existent relationship with the owner.
7. Data protection and cookies
The processing of the personal data of users, customers and people whose professional contact details appear in the databases is described in the Privacy Policy. 8. Governing law and jurisdiction
This Legal Notice is governed by the laws of Georgia, without prejudice to any mandatory rules that may apply, in particular those protecting consumers resident in Spain. For disputes with users who are consumers, the competent courts and tribunals shall be those determined by the applicable law, including those of the consumer's place of residence.
